Terms of service

Eraframe · Effective date: 2026-09-16 · Version 1.0

1. Who we are

Eraframe is provided by MB Makery, a company registered in the Republic of Lithuania, company code 307770736, VAT not VAT registered, registered office V. Nagevičiaus g. 3, LT-08237 Vilnius, Lithuania. Contact: support@developers911.com, https://www.developers911.com/eraframe/.

In these terms, "we" and "us" mean that company; "you" means the person using the app; "the service" means the Eraframe Android app together with the server that generates portraits.

2. Acceptance and eligibility

By installing or using Eraframe you agree to these terms and to the privacy policy. If you do not agree, do not use the service.

You must be at least 18 years old. The service is not directed at children, and you may not use it if you are under 18. If you are using the service on behalf of an organisation, you confirm you are authorised to bind it.

3. What the service does

You supply one photograph and choose between one and eight photographic styles. We send the photograph to a third-party artificial intelligence image model with a text prompt, and return stylised black-and-white portraits.

The portraits are generated by a machine. They are new, synthetic images. They are not photographs of anything that happened, and they may differ from the source photograph in appearance, age, clothing, background and detail.

4. Licence to use Eraframe

We grant you a personal, limited, non-exclusive, non-transferable, revocable licence to install and use the app on devices you control, for your own use and, if you have an Eraframe Pro subscription, in line with that subscription.

You may not copy, sell, rent, sublicense, decompile or reverse-engineer the app, except to the extent that Lithuanian or EU law expressly permits despite this restriction. All rights in the app, its design, its style catalogue and its prompts remain ours.

5. Your photograph and your responsibility for it

Before each roll you must confirm: "This is me, or I have permission to use this photo."

By submitting a photograph you confirm that:

You keep ownership of your photograph. You grant us a limited, worldwide, royalty-free licence to store, re-encode and transmit it to our image-generation provider, solely to produce the portraits you asked for and for the short retention periods set out in the privacy policy. That licence ends when the photograph is deleted. We do not use your photograph for any other purpose, and we do not use it to train models.

7. What AI-generated output is, and is not

Every generated image carries an "AI" badge in the app, is shared with the text "Made with Eraframe · AI-generated", and carries metadata marking it as AI-generated. You must not remove or obscure these markings when you publish or share an image. Doing so may breach the EU AI Act and the rules of the platform you post to.

8. Rights in the generated portraits

To the fullest extent we are able, we assign and grant to you all rights we hold in the portraits generated from your photograph, so that you may use, save, share, print and publish them, including commercially, subject to these terms and to the terms of our image-generation provider (Google Generative AI Prohibited Use Policy).

Two limits are honest to state. We can only grant what we hold: the output is produced by a third-party model under that provider's terms, and those terms also apply to you. And in several jurisdictions, works generated by a machine without sufficient human authorship may attract no copyright at all, so we make no promise that the portraits are protected by copyright anywhere.

We do not claim any right to publish your images, and we do not use them for marketing.

9. Moderation, refusals and reports

We may refuse to process any photograph or style, remove any generated image, and restrict or end your access, where we reasonably believe these terms or our content policy have been broken, or where the law requires it.

Every generated image can be reported from inside the app, through the report control in the results grid and in the full-screen viewer. Reporting an image does not by itself mean it will be removed, and images are in any case deleted automatically after 24 hours.

10. The free roll

Each installation of the app includes one free roll. It is a courtesy, not an entitlement: we may change or withdraw it, and we may refuse it where we detect an attempt to obtain repeated free rolls by reinstalling or by using multiple devices. Free rolls are generated at a lower quality setting than Eraframe Pro rolls.

11. Eraframe Pro subscriptions

Eraframe Pro is an auto-renewing subscription sold through Google Play Billing.

12. Right of withdrawal for EU consumers

If you are a consumer in the EU you normally have 14 days to withdraw from a contract for digital content, under Directive 2011/83/EU as transposed in Lithuania.

Eraframe Pro is supplied immediately, so that you can use it as soon as you subscribe. When you purchase, you expressly request immediate performance and acknowledge that you lose the right of withdrawal once performance has begun, as Article 16(m) of that Directive allows.

Where the right of withdrawal still applies — for example if you have not used the subscription and immediate performance has not begun — contact support@developers911.com. Because Google Play is the seller of record, a refund is usually processed by Google.

Nothing in this section limits your rights where the service is faulty or not as described. Digital content must conform to the contract under Directive (EU) 2019/770 as transposed in Lithuania, and your remedies under that law are unaffected by these terms.

13. Availability and changes

We aim to keep the service available, but we do not promise it will be uninterrupted or error-free. It depends on third-party infrastructure and on an image-generation provider we do not control, and it may be unavailable for maintenance, capacity or supplier reasons.

We may change, add or remove features, including styles, quality levels and allowances. Where a change materially reduces what a paying subscriber receives, we will give notice in advance and you may cancel.

We may change these terms. The current version is always published at https://www.developers911.com/eraframe/. Material changes will be notified in the app before they take effect, and continuing to use the service after that means you accept them.

14. Warranties and liability

The service is provided as it is and as available. Beyond what the law requires, we give no warranty of merchantability, fitness for a particular purpose, accuracy, likeness or non-infringement.

Nothing in these terms excludes or limits our liability for death or personal injury caused by our negligence; for fraud or fraudulent misrepresentation; for intent or gross negligence; or for anything else that Lithuanian law does not allow to be excluded or limited, including your mandatory rights as a consumer.

Subject to that, and to the maximum extent Lithuanian law allows: we are not liable for indirect or consequential loss, loss of profit, loss of data, loss of goodwill, or for how you or anyone else uses a generated portrait; we are not liable for the content of generated images, which is produced by a model responding to your photograph and to your choice of style; and our total liability arising out of the service in any 12-month period is limited to the greater of the amount you paid us for the service in that period and EUR 50.

You are responsible for how you use the portraits, including for having the permissions described in section 5.

15. Termination

You may stop using the service at any time by uninstalling the app, and you may delete your data at any time through Settings → Delete my data. Uninstalling the app does not cancel a subscription: cancel it in Google Play.

We may suspend or end your access where you seriously or repeatedly break these terms or the content policy, or where we must for legal reasons. Where it is reasonable and lawful, we will give you notice and a chance to respond. If we end access to a paid subscription without cause attributable to you, we will arrange a pro-rata refund for the unused period.

Sections 5, 7, 8, 14 and 16 survive termination.

16. Governing law and disputes

These terms are governed by the law of the Republic of Lithuania. If you are a consumer resident in another EU country, you also keep the protection of the mandatory rules of your own country's law.

Disputes go to the competent courts of the Republic of Lithuania. If you are a consumer, you may also bring proceedings in the courts of the country where you live, and we will bring proceedings against you only there.

Out-of-court resolution. Please contact us first at support@developers911.com; most problems are settled that way. The European Commission's Online Dispute Resolution platform is no longer available: it stopped accepting new complaints on 20 March 2025 and ceased operating on 20 July 2025 under Regulation (EU) 2024/3228. Consumers should instead use a national alternative dispute resolution body or European Consumer Centre. In Lithuania that is the State Consumer Rights Protection Authority [verify the current name and web address before publishing]. We are not obliged to use, and do not commit to, any particular ADR body.

17. Miscellaneous

If a provision is found invalid, the rest stays in force. Failing to enforce a provision is not a waiver of it. You may not transfer your rights under these terms; we may transfer ours as part of a reorganisation or sale of the business, without reducing your rights. These terms, with the privacy policy, the content policy and the AI transparency statement, are the whole agreement between us about the service.

Your relationship with Google in respect of Google Play, and any purchase you make there, is governed by Google's own terms.
